Akkuyu Fukushima olamaz!

Nükleer kaza deyince herkesin aklına önce Çernobil kazası geliyor. 1986 yılında meydana gelen Çernobil’den önce de kazalar yaşanıyordu. Ancak hiçbir kaza Çernobil kadar sarsıcı ve geniş çaplı olmadığı için bu kadar gündemde değildi.

Bilinen önemli nükleer kazalardan birisi 29 Eylül 1957’de Rusya, Kyshtym’da yaşandı. Soğutma sisteminin aksaması nedeniyle sıvı atık tankında yangın meydana geldi. Kazaların 1-7 arasındaki derecelendirilmesini gösteren uluslararası nükleer skalasına göre işbu kaza “6” seviyesindeydi.

Çernobil öncesi diğer bir kaza 10 Ekim 1957 yılında İngilitere Sellafield’da İngiliz nükleer programına plütonyum üreten Windscale Reaktör 1`de yangın çıkmasıyla yaşandı. 28 Mart 1979’da ise ABD, Harrisburg Pensilvanya’da meydana gelen kaza, Three Mile Adası Santrali 2 numaralı reaktörde meydana geldi. Her iki olay da uluslararası nükleer kaza skalasına göre 5 seviyesindeydi.

Bilinen en büyük nükleer kaza ise yazımızın en başında da belirttiğimiz gibi, 26 Nisan 1986’da, Ukrayna’da bulunan, Çernobil nükleer santralinde yaşandı. Santralin 4 numaralı reaktöründe güvenlik testi sırasında operatörlerin yol açtığı çekirdek erimesi sonucu yaşanan patlama, 1000 tonluk çatıyı uçurarak Avrupa`yı radyoaktif bulutlara maruz bırakmıştı. Çernobil faciası ise uluslararası nükleer olay skalasına göre kaza 7 seviyesindeydi. Bu yüzden kazanın etkileri çok uzun sürdü, halen de sürüyor.

Kazaların hukuki durumlarına bakacak olursak… Çernobil felaketi esnasında, Sovyet Sosyalist Cumhuriyetleri Birliği (SSCB) nükleer hukuki sorumluğa ilişkin herhangi bir uluslararası sözleşmeye taraf değildi. SSCB’nin iç hukukunda konuya ilişkin herhangi bir düzenleme de yer almıyordu. Dolayısıyla kişilerin ve ülkelerin mağduriyetleri büyük oldu.

Çernobil’den sonra da dünyanın çeşitli ülkelerinde birçok nükleer kaza meydana geldi. Fakat bunlardan hiçbirisi uluslararası nükleer olay skalasına göre 4 seviyesinin üstüne çıkmadı. Günden güne gelişen teknoloji ve nükleer eğitimi bu kazaları, risklerini ve sonuçlarını minimize etti.

ÇERNOBİL SONRASI EN BÜYÜK KAZA; FUKUSHİMA

Herkesin bildiği gibi 11 Mart 2011’de Japonya, Fukushima’da büyük bir nükleer kaza meydana geldi. Ve bu kaza hem oluş şekli hem de etki alanı sebebiyle dünyada büyük yankı uyandırdı. Bu kazanın meydana geliş biçimi o güne kadar yaşanmış tüm nükleer kazalardan farklıydı. O tarihte yaşanan Tōhoku depremi Japonya`da büyük bir tsunamiye yol açtı. Tsunami de nükleer kazanın nedeni oldu.

Santralin 5.7 metrelik bir tsunamiye dayanabilecek önlem amaçlı bir duvarı varken depremden sonra santral 14 metrelik bir tsunamiye maruz kalmıştı. Bu yüzden söz konusu duvarın herhangi bir koruyucu etkisi olamadı. Uluslararası nükleer olay skalasına göre Fukuşima kazası da 7 seviyesinde, yani Çernobil ayarındadır.

Japonya hali hazırda nükleer kazalarda devlet ve işleten şirket sorumluluklarını düzenleyen Paris ve Viyana konvansiyonlarına taraf değil. Ancak ülke bu alanda kendi ulusal mevzuatına sahip. Japonya’da nükleer kazalardan dolayı hukuki sorumluluk, iki ayrı kanunda düzenlenmiş durumda. Nükleer Zararlardan Sorumluluk Yasası (Law on Compensation for Nuclear Damage) ve Tazminata İlişkin Sorumluluk Anlaşmaları Yasası (Law on Indemnity Agreement for Compensation).

DEVLET VE İŞLETENİN KAZALARDAKİ TAZMİNAT SORUMLULUKLARI

Fukuşima sonrası nükleer güvenliğin önemi daha da arttı ve ulusların ortak bir hukuki altyapı geliştirmeleri gerekliliği ortaya çıktı. Zira yaşanan kazaların etki süresi, bu etkilerin kazaya sebep olan ülkeyi aşıp bir diğer ülkeye sıçraması, kazaların sonuçlarının maddi olarak tazmin edilmesinin fiili olarak imkansızlaşması durumu ve sorumlu ülke devletinin ve diğer ülkelerin buna katkısı hususları önemli hale geldi.

AKKUYU FUKUSHIMA OLAMAZ

Kazaların geneline bakacak olursak, doğal afet kaynaklı olanların dışındaki kazaların ya eski teknoloji ile kurulmuş reaktörlerde zamanla oluşan teknik problemlerden veyahut santralde çalışanların bireysel hatalarından kaynaklandığını görüyoruz. Şu anda Mersin’de inşa edilecek nükleer santral, teknik olarak kendisini ispat etmiş en yeni nükleer teknolojiyle kurulacak. Şu anda son teknolojiye sahip 3. nesil reaktörler daha öncekilerin aksine pasif güvenlik sistemlerine sahip ve elektriksiz olarak çalışabiliyor.

Burada kısaca bahsetmekte yarar görüyoruz ki Mersin Akkuyu Santrali’nde tsunami riski yok. Mersin tsunami bölgesi değil çünkü açık okyanusa kıyısı bulunmuyor. Deprem ve diğer doğal afet risklerinin değerlemesi için geçtiğimiz günlerde onaylanan Akkuyu ÇED raporu incelenebilir. Dolayısı ile Mersin Akkuyu’nun yeri bir nükleer santral kurulması için en iyi ve güvenilir yerlerden biri. Bu son teknolojiye dayalı kurulacak Türkiye’nin ilk nükleer santrali 8 şiddetinde depreme dayanabilecek nitelikte. 9 şiddetindeki olası bir deprem anında ise güvenli şekilde kapanacak. Santral 20 tonluk bir uçağın çarpma ihtimalini de tolere edebilecek.

How the accidental risks of Turkey’s first nuclear power plant which will be located in Mersin are eliminated?

When we talk about nuclear disasters, Chernobyl accident comes to the minds. There were accidents before Chernobyl accident that happened in 1986. However, the other accidents were not the agenda for the reason that they were not shocking and large scaled this much.

One of the very well-known and significant nuclear accidents happened in Russia, Kyshtym on 29th of September, 1957. There was fire in the liquid waste tank in consequence of the failure at the cooling system. According to the international nuclear accident scale which shows the accident ratings between 1-7, the level of this accident was “6”.

Another accident before Chernobyl happened in England, Sellafield on 10th of October, 1957 due to the fire in Windscale Reactor 1 which was producing plutonium for English nuclear program. And, the accident that happened in the USA, Harrisburg on 28th of March, 1979 occurred in the reactor 2 in Three Mile Island. Both accidents were rated as the level “5” under the international nuclear accident scale.

The biggest known nuclear accident happened in Chernobyl nuclear power plant on 26th of April, 1986 as we mentioned at the beginning of our article. The explosion, which occurred due to the core melting caused by the operators during the safety test at the reactor 4 of the plant, blew the roof of kiloton away and exposed to radioactive clouds over the Europe. Chernobyl accident was rated as the level “7” under the international nuclear accident scale. Therefore, the effects of this accident have been continuing.

Let’s take a look at the legal situation of the accidents… During the Chernobyl accident, Union of Soviet Socialist Republics (USSR) was not a party of any international treaty regarding the legal liability on nuclear. And, there were no internal legal legislation of USSR on this subject. Accordingly, there were huge damnification of the states and people.

Too many nuclear accidents happened in the different states after Chernobyl accident. On the other hand, none of them exceed the rate level “4” under the international nuclear accident scale. The technology which is developing day by day and nuclear energy education have minimized the risks and negative results.

THE BIGGEST ACCIDENT AFTER CHERNOBYL; FUKUSHIMA

As everyone knows, a huge nuclear accident happened on 11th of March, 2011 in Japan, Fukushima. And such accident made a tremendous impact all over the world reasoning both the occurrence and the mode of action of it. Occurrence of this accident was different than the other accidents happened before. Tohoku earthquake that happened in the same date of the accident caused a tsunami in Japan. And the tsunami caused the nuclear accident.

When there was a wall set which may stand on a tsunami of 5.7 meters, the power plant was subject to a tsunami of 14 meters. Therefore, subject wall had no protection effect. Under the international nuclear accident scale, Fukushima accident is rated as the level “7”; in other words, it is the same level with Chernobyl.

Currently, Japan is not a party of the Paris and Vienna Convention which contains the liabilities of the states and the operators regarding the nuclear accidents. On the other hand, Japan has its internal legislation on this issue. Legal liability regarding the nuclear accidents has covered by two different laws: Law on Compensation for Nuclear Damage and Law on Indemnity Agreement for Compensation.

LIABILITY OF THE STATES AND THE OPERATORS ON THE DAMAGES REGARDING THE ACCIDENTS

After Fukushima, importance of nuclear safety has increased and the necessity of the common legal structure of the nations has come into existence. Yet, affection period of the experienced accidents, expansion of the effects which are outreached from the generated state to the other states, actual impossibility of compensation of the financial damages regarding the results of the accidents and contribution of the responsible state and others has become significant.

AKKUYU CAN NOT BE FUKUSHIMA

As a general overview to the accidents, we see that the accidents are caused by the technical problems that occurred on the reactors in time installed with the old technology or individual mistakes of the employees who work for the power plants, except the natural accident caused accidents. The power plant which is planning to be established in Mersin will be formed with the state of art technology. Now, 3rd generation reactors with newest technology have passive safety system and may work without electricity as contrary to the previous ones.

We think that it is good to talk about the fact that there is no tsunami risk for Mersin Akkuyu Power Plant. Mersin is not a tsunami area since it does not have a coastal side to the ocean. Environmental Impact Assessment Report of Akkuyu, which has approved recently, can be reviewed for the evaluation regarding the risks for earthquake and natural accident. Thus, Mersin Akkuyu area is one of the best and safety place to be located for NPP.Turkey’s first nuclear power plant, which will be established with the state of art technology, has the qualification to resist on an earthquake rated as 8. In case of an earthquake rated as 9, it will automatically be shut down in safe manner. The plant will also tolerate a possible crash of an aircraft of 20 tons.
